Accidents Caused by Unsecured Loads

Recently, an unsuspecting Florida driver sustained major injuries after a load of furniture being hauled on a truck in front of her came loose. The driver was heading home from a flea market when pieces of furniture piled high on a truck bed began to tumble off and into the roadway. One of the bigger pieces smashed up the front of her car, causing over $10,000 in damages. The driver’s baby, who was strapped into a carseat, was uninjured, but the driver sustained injuries to her head and neck, including a large gash that required staples to close. To add insult to injury, her insurance company is refusing to pay for her expenses, and the driver of the truck didn’t even stop to make sure that she was alright.

The injured driver is searching for witnesses who may be able to help identify the truck or its driver, appealing to other drivers through Facebook. It is a moving violation to have an unsecured or improperly secured load, and the car driver is asking for the guilty truck driver to come forward and assume responsibility for his or her actions.

All drivers have a duty to act with care on the road, and for truck drivers hauling loads, this includes assuring that their loads are properly secured. Any involved parties, including those who loaded the truck, can be held liable for an accident resulting from a poorly managed load. Often, responsibility for injuries is shared between truck drivers, trucking companies, loading dock workers, vendors, manufacturers, and installers of trucking equipment.

In addition to accidents caused by unsecured loads, many other things can go wrong with trucks on the road. Including errors made by the driver, due to distraction, exhaustion, or the influence of drugs or alcohol; malfunctioning truck equipment; poor weather conditions; and under-qualified drivers who were incapable of handling the truck and its load.
