Personal Injury Cases in Florida: Average Case Values

Over the past few months, we’ve researched different kinds of injuries and cases which have faced a jury in the State of Florida. 30 research topics later, we’ve created a list of each topic and its average case value with and without defense verdicts and outliers that we saw in the sample chosen for each topic.

  1. Achilles’ tendon injuries showed an average case value, with defense verdicts and outliers, of $104,478.67. Excluding them, the average case value dropped to $51,401.55.
  2. Above-knee amputations showed an average case value of $3,198,141.65 including defense verdicts and outliers and an average case value of $3,114,897.10 without them.
  3. Above-elbow amputations showed an average case value of $8,515,305.85 with defense verdicts and outliers and $1,160,178.83 without them.
  4. Below-knee amputations showed an average case value of $1,096,082.69 with defense verdicts and outliers and an average case value of $1,488,804.48 without them.
  5. Below-elbow amputations showed an average case value of $2,080,248.72 including defense verdicts and outliers and an average case value of $1,580,900.99 excluding them.
  6. Cases involving a plaintiff’s blindness showed an average case value of $1,315,131.97 including defense verdicts and outliers and an average case value of $967,429.46 without them.

  28. Wrongful death cases showed an average case value of $1,924,027.99 including defense verdicts and outliers. The average case value dropped to $1,212,576.72 excluding them.
  29. Wrongful death cases where the parent of the decedent was the plaintiff showed an average case value of $1,747,113.27 including defense verdicts and outliers and an average case value of $1,689,881.19 excluding them.
  30. Wrongful death cases that took place in Gadsden County showed an average case value of $1,287,890.55. This sample did not have any defense verdicts or outliers.

One quick note to be aware of is that each average case value was calculated in a random sample taken from jury verdict research. As such, these samples may be very small. It is important to use these averages as a guide; however, be aware that they may not be completely representative of a population of interest if the sample size wasn’t large.
