What is personal injury lawyer?
A personal injury lawyer is a lawyer who practices in the area of personal injury law. Personal injury lawyers represent clients who have been injured, or whose loved ones have been killed, or who have suffered a property loss, because of someone else’s actions- or their failure to act. These include injuries or a wrongful death from auto accidents, truck accidents, DUI accidents, birth injuries, slip and fall, dangerous and defective products, and medical malpractice. A personal injury lawyer is not a criminal defense lawyer. A personal injury lawyer is a plaintiff’s lawyer; she does not defend the person or company that caused the injury or wrongful death.
How do I know if I have a personal injury case?
First, you must have suffered an injury, to yourself or to your property, and that injury must be someone else’s fault. Determining if someone else is legally at fault for your injury can be difficult to do, and just one of the reasons why it is prudent to hire a personal injury lawyer. A personal injury lawyer can go over the details of your case with you, and help you determine the appropriate course of action.
How do I know which attorney I should hire?
Hiring a personal injury lawyer can seem like a daunting task, especially if you’re feeling overwhelmed with the aftermath of your accident, or the death of a loved one. That’s why the attorneys at Fasig & Brooks have put together a list of five questions you should ask any personal injury lawyer before hiring him.
How much does a personal injury lawyer cost?
The personal injury lawyers at Tallahassee Law Firm Fasig & Brooks work on a contingency fee basis. Our fees will be a percentage of any damages you are awarded. If you don’t win, we don’t get paid.
What happens if I file a lawsuit?
If your personal injury attorney recommends filing a lawsuit, it means that she has not been able to reach a reasonable settlement with the insurance company. When that happens, you will become the plaintiff, and the person who injured you will become the defendant. After that, the lawyers for each side will begin the process of readying your case for trial. That could include, among other things, depositions of experts, witnesses, and yourself. After both sides have gathered all the facts of the case, you will go to trial. However, most cases settle before ever reaching a courtroom. A case can be settled, if both sides agree, at any point during this process. If your case goes to trial, then a jury (although, sometimes a plaintiff asks a judge to hear the case) will hear the case and determine the outcome of your case.
